Property Inspection Agreement
1) The property inspection is limited to visual observations of apparent conditions existing at the time of the inspection. When necessary and appropriate the inspector will perform simple mechanical tests to determine whether or not a system or appliance is in good working order.
2) The inspection and report are performed and prepared for the sole, confidential and exclusive use and possession of the customer and /or the customer's agent or delegate. If the inspector recommends consulting other specialized experts, any such consultation shall be at the customer's sole discretion and expense.
3) This inspection is not intended to be technically exhaustive nor is it considered to be a GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, REGARDING THE CONDITIONS OF THE PROPERTY, ITEMS AND SYSTEMS INSPECTED AND IT SHOULD NOT BE RELIED ON AS SUCH. The Inspector shall not be held responsible or liable for any repairs or replacements with regard to this property, systems, components, or the contents therein.
4) Deficiencies and defects, which are latent or concealed, are excluded from the inspection. The inspector is not required to move debris, furniture, equipment, carpeting or other items, which may impede access or limit visibility, or enter any area with less than 24 inches clearance. Detached buildings are not included.
5) This inspection is not a substitute to replace any real property disclosure statements required by law; nor does it substitute or replace any disclosure obligation of the customer.
6) Systems and conditions which are not within the scope of this inspection include, but are not limited to: environmental hazards (e.g., lead paint, formaldehyde, toxic or flammable materials, asbestos, radon gas testing, and mold testing); pest infestation; portable appliances (e.g., washers, dryers, window air conditioners); furnace heat exchangers, fire sprinkler systems; tennis courts; playground or other recreational or leisure equipment; septic tanks; water wells or any item considered cosmetic in nature. Any general comments about these systems or conditions are informational only and do not represent an inspection of such. Radon gas testing and mold testing can be done separately.
7) The inspection is performed in compliance with accepted standards of practice and performance and conforms to the standards established by the Georgia Association of Home Inspectors (GAHI). http://www.gahi.com/GAHI_Standards_of_Practice.pdf.
8) If Client is married, Client represents that this obligation is a family obligation incurred in the interest of the family.
9) The client further agrees that the Inspector is liable only up to the cost of the inspection. Liability is also limited to one year.
10) Any matter concerning the interpretation of this Agreement, of the Inspection Report, or any claim based upon either of them shall be subject to mediation between the parties or failing such mediation shall be resolved by arbitration in accordance with the Construction Industry Arbitration Rules of the American Arbitration Association, except for the rules pertaining to the arbitrator selection. The three (3) arbitrators should have knowledge of the home inspection industry and one arbitrator must be a Home Inspector with at least five (5) years of Home Inspection experience
11) The inspection service is conducted at the property. The physical on-site inspection of the property is a very valuable time of exchange of information between the Inspector and the Client. Any particular concern of the Client must be brought to the attention of the Inspector before the inspection begins. The written report will not substitute for Client's personal presence during the inspection. It is virtually impossible to fully profile any building with any reporting system. Unless Client attends and participates in the inspection process itself, the Client will have no chance of gaining all of the information that is offered.
12) Severability. The Client and the Inspector agree that should a court of competent Jurisdiction determine that any portion of this agreement is unenforceable, the remaining provisions and portions of this agreement shall remain in full force and effect.
13) Notification. The Client must commence any action for damages arising out of or related to this Agreement or the Inspection Report within one year of delivery of the Home Inspection Report to the client or the named representative.
14) Agreement Available. The undersigned has read, understood and accepted the terms and conditions of this agreement and agree to pay the charges specified in the attached cover letter. :
